This short term rental AirBnB is not registered and I dont think it should be able to. This home uses two legal addresses on paper. 20 Powder House Road Extension and 22 Powder House Road Extension. It is a legal single family home. This single family home status was confirmed when the Building Department ordered a demolition of illegal partitions in the basement to remove a two family modification in 2021/2022. Unfortunately this enforcement action did not deter the absentee landlord from Weston, MA who once again partitioned the home into two units as shown with the two AirBnB 'entire unit/home' links below.
I hope the Mayor's office and City's legal team will support the building department with the appropriate enforcement of this property. Based on a lack of response to a 11/7/2023 email to the City requesting information, there does not seem to be the legal support needed for these types of complex violations that are only tangentially related to building codes.
The homeowner has owned the building since 2007. Right around the time that the building code violation issue was wrapping up in 2022, the owner then 'sold' the home for $10 to his partner's LLC called 'USA WEST EAST EASE, LLC'. Unfortunately the owners real estate attorney wasn't paying attention since the legal name of the LLC his partner owns is actually USA WEST EASE LLC. This is further complicated by the fact that no annual filing has been submitted for this LLC for 2022 and it risks being administratively dissolved in 2024.
No permit should be issued for this short term rental property until its current violations are resolved and a state registered legal entity with current annual filings matches the name on the Deed.

In September the building department reached out to Arthur and David Martiroso who run the DNA Realty Group in Andover and tried to have them register this Short Term Rental AirBnB. The Realty Group informed the building department that this rental was for 30 days or longer. Now they have back tracked and are renting for a minimum of 15 nights. Please reach out to them again. I hope that the Mayor's office and our legal representation support the building department with this interaction as it is clearly NOT a misunderstanding. Delisting for 30 days does not change the need for a permit.
